Relevant South African Legislation

Consumer Protection Act 68 of 2008 (“CPA”) - regulates the relationship between a supplier of goods and/or services to a consumer. The Act sets out the minimum requirements to ensure adequate consumer protection in South Africa. All Basic Sense auctions and sales solutions services are conducted in accordance with all applicable provisions of the CPA.
Estate Agency Affairs Act 112 of 1976 (“EAAA”) - provides for the establishment of an Estate Agency Affairs Board and an Estate Agents Fidelity Fund for the control of certain activities of estate agents in the public interest and for incidental matters.
Financial Intelligence Centre Act 38 of 2001 (“FICA”) - was established to combat financial fraud and money laundering and the financing of terrorist and related activities. The act further to impose certain duties on institutions and other persons who might be used for money laundering purposes and the financing of terrorist activities. These duties include ‘customer identification and verification', record-keeping and reporting obligations.
Sub-regulation 21(2)(a) of the Second Hand Goods Act 6 of 2009 and sub-regulation 26(2) of the Consumer Protection Act 68 f 2008 requires Basic Sense to establish and verify the identity of every seller, bidder and buyer. Second Hand Goods Act 6 of 2009 - regulates the business of pawnbrokers and dealers in the second-hand goods in order to combat trade in stolen goods and promote ethical standards in the second-hand goods trade. As a registered second-hand goods dealer Basic Sense conducts all second-hand goods transactions in accordance with all applicable provisions of the Second Hand Goods Act 6 of 2009.
